What is mediation?

In simplest terms, mediation is intervention in a dispute between two or more parties, by a neutral (unbiased) 3rd party, in an attempt to help each reach an agreement. A mediator's job is to listen to each party, help define their interest and position, and negotiate solutions through a series of conversations. Mediators do not make decisions for the parties involved in the dispute. We guide participants into win-win solutions.


WHY MEDIATE?

Mediation is a speedier, less expensive route to tailored resolutions, through a confidential process designed to enhance communications and improve relationships.


Many matters that would be pending for years have been resolved in mediations lasting one day.

The mediation fee, which can be split by all parties, is a small fraction of the cost of litigation fees incurred over the life of an average case. The shortened mediation process allows everyone involved to work without the interruptions of a full trial.

Mediation permits parties to create remedies designed to fit their unique needs, values, and circumstances, permitting "win/win" solutions. Structured payments, letters of recommendation or apology, confidentiality agreements, barter, and agreements for future business are just a few of the resolutions available in mediation that parties may not obtain from judgments after trial.

Mediation provides a private setting where parties can freely discuss their concerns, ensuring that sensitive information remains confidential and does not become part of the public record.

With the help of a professional neutral who demonstrates active listening, parties are encouraged to communicate more effectively. This reduces tensions and misunderstandings that can block progress, allowing everyone to express themselves more openly and feel heard. The communication skills and understanding gained during mediation can benefit them long after the dispute is resolved.

Relationships with family members (including those in family businesses), neighbors, and friends, as well as employment relationships, business partners, competitors, and more, can all benefit from the collaborative nature of the mediation process.

All stages of mediation—from intake to resolution—can be done remotely, making it easier and more convenient for everyone involved. Not only does this save on travel costs, but it also allows participants to stay in comfortable, familiar surroundings. This "home field advantage" can help each person feel more at ease, making it easier to engage and communicate effectively throughout the process.

About

Michelle Francesca Thomas earned a B.A. in Psychology from William Paterson University after beginning her studies at Seton Hall University, giving her a strong foundation in understanding human behavior and decision-making.Ms. Thomas serves on the roster of approved mediators for the New Jersey civil courts and is currently pursuing registration with the Georgia Office of Dispute Resolution. She completed formal mediation training through Essex County College (ABA-approved) and brings over 20 years of experience in nonprofit work, including housing development, fair housing rights, education, and community engagement.She has completed additional training through the New Jersey Division on Civil Rights in workplace and housing discrimination under the NJ Law Against Discrimination (LAD), as well as the Fair Chance in Housing Act, informing her work in disputes involving access, equity, and workplace or housing-related conflict.In addition, she brings over a decade of ongoing experience in media production, with expertise in team leadership, contract negotiation and management, and process improvement—bringing a practical, solutions-oriented perspective to complex disputes.Ms. Thomas approaches mediation with a focus on clarity, fairness, and forward movement, helping parties reach practical, durable resolutions.Contact Michelle to begin your next steps toward resolution.
